Bankruptcy litigation is the official method to get debt relief through court. Laws related in this litigation is depicted in Article1 Section8 of the constitution. Bankruptcy is either voluntary or involuntary; voluntary is filed by a debtor and filed by a creditor is involuntary. This litigation is also called liquidation in Chapter 7 as it involves the selling of all the assets of a debtor to the creditor and cancels all the debts.
Chapter 11 in the American Constitution deals with the business bankruptcy and it controls the reorganization of the business. When the business is running under debt, they can file a case with a bankruptcy court for the protection based on Chapter 11. After filing, all the debts and problems are supervised by the court. At that time company can start a new because in some cases the court will cancel all the debts. Based on the complexity and size, a company will become free after few months or years under Chapter 11. If the debt of the company outweighs the asset, the stockholders will not get anything. Then the company will be reorganized by the creditors and the new stockholder may bring success to the company in order to compensate the initial losses. The handing over the ownership keep the work and the asset safe and businesses will go without debt.
Corporate bankruptcy is the legally declared process when the business body that they could not able to meet its problems and want the protection from the court with the help of its creditors. In The US, there are Chapters for the businesses bankruptcy; Chapter7 and Chapter 11, so that case can be under either of the two chapters.
